1. Definitions
By using the MooseDM app and all related Shopify apps, you agree to be bound by the following terms and conditions. You will not use the apps ("Service") for any purpose that is unlawful or prohibited by these Terms. By using the website or the apps, you fully accept the terms, conditions and disclaimers in this notice. If you do not accept these Terms, you must immediately stop using the apps and the Service.
a. Scope of Agreement
This Agreement governs the use of our Services by all users, including:
- Merchants: organisations or individuals using our Services to automate Instagram comment replies and direct messages for their store under a chosen subscription plan.
- Shoppers: individuals who interact with a Merchant's Instagram posts or messages that are handled by our Services.
The term "Users" covers all individual end-users of the Services, including any employee, representative, consultant, contractor or agent of a Merchant, every Shopper, and all other end-users.
b. Parties to the Agreement
"You" and "your" refer to:
- you, if acting in your individual capacity; or
- the legal entity on whose behalf you are entering into this Agreement, if acting on behalf of another legal person.
If you are an individual entering into this Agreement personally, including as a sole proprietor acting as a Merchant, you are also considered a User. If you are a User acting on behalf of another legal person, such as a corporation, you confirm that you have the authority to legally bind that entity. You are responsible for ensuring that every employee, representative, consultant, contractor or agent using the Services on your behalf follows this Agreement. For Merchants, this includes any User who creates an account associated with your business ("Account").
c. Applicability
This Agreement applies to your use of our Services even if you access them through a third-party platform integrated with ours, including Shopify and Instagram.
2. User Accounts
MooseDM does not require merchants to create a separate account to access certain features of the app. You are responsible for keeping your Account, Shopify and Instagram login details confidential and for restricting access to your devices. You accept responsibility for all activities that occur under your Account, including the automations you set up and the messages they send.
3. MooseDM Rights
MooseDM offers various features and services, but not all of them are available to all users at all times. We are not obligated to provide any specific service or feature in any location. Unless prohibited by these Terms or by law, we may change or remove services or features at any time without notice.
MooseDM does not pre-screen content ("Materials") and may, at its sole discretion, refuse or remove any Materials, including where the replies, messages or Materials you create violate our Acceptable Use Policy, Meta's Platform Terms or these Terms.
Any verbal or written abuse, including threats, directed at MooseDM employees, members or officers will result in immediate termination of your Account.
We may provide our services to your competitors and do not guarantee exclusivity. You also acknowledge that MooseDM employees or contractors may use our services as merchants and could compete with you, but they will not use your confidential information in doing so.
If there is a dispute over account ownership, we may request documentation to verify the rightful owner, such as a business licence, government ID, the last four digits of the card on file or proof of employment with the business. MooseDM reserves the right to determine the rightful account owner. If ownership cannot be determined, we may temporarily suspend or disable the Account until the issue is resolved.
If we detect unusual activity from a store within the app — including messaging activity that Meta restricts or that shoppers report as spam — we reserve the right to suspend any feature without prior notice, to protect user privacy and the rights of app users and to keep your Instagram account in good standing.
4. Information We Collect
We collect certain information about you and your shoppers when you use the app, including:
- your Shopify store details (store name, store URL, store owner name, contact email and time zone), your product and collection catalog, and orders placed in your store;
- the name, email address and language preference of app users in your store, provided by Shopify;
- your Instagram account ID and username, and an access token that lets us reply to comments and send messages on your behalf;
- for posts you choose to automate, the media ID, caption and thumbnail;
- your automation settings, including trigger keywords, reply and message templates, and linked products or collections;
- shoppers' Instagram username and user ID;
- comment text on automated posts
- messages sent and received through your automations
- follow status, when follow-gated DMs are used
- link clicks and attributed orders
We may also monitor metrics such as shoppers engaged, shoppers reached, store clicks and attributed revenue, to give you insight into how your automations perform. See our Privacy Policy for full details.
5. How We Use Your Information
We use the information we collect to:
- provide and improve the app and related services;
- send you marketing and product changelog emails;
- track usage with analytics tools [Google Analytics & Mixpanel];
- respond to your enquiries and support requests.
6. User Content
You may create content ("User Content") while using the app, including reply templates, message templates and trigger keywords. You retain all ownership rights to your User Content. By submitting User Content to the app, you grant us a non-exclusive, royalty-free licence to use, reproduce, modify, publish and distribute it in connection with operating the app.
You are solely responsible for the replies and messages your automations send, and for making sure they comply with Meta's Platform Terms, Instagram's Community Guidelines and all laws that apply to your business and your shoppers.
You also grant us the right to identify you as a user of the app and to use your business name, trademarks, logos and publicly available information in customer showcases, case studies, educational content, marketing materials and other promotional activities. We will not disclose confidential information or non-public business data without your prior written consent.
7. Purchases
The app may offer paid plans and additional services, such as recurring monthly or annual subscriptions. Charges are billed through Shopify's app billing and appear on your Shopify invoice. You agree to be bound by Shopify's billing terms.
8. Changes to the Terms
We may revise these Terms at any time by posting the revised Terms in the app or on this website. Please check this page periodically so you are aware of any changes, as they are binding on you.

10. Entire Agreement
